UPDATE ON LIEUTENANT'S TEST

Yesterday (Thursday, April 23, 2009) representatives of the Fraternal Order of Police, the Police Association of New Orleans, and the Black Organization of Police attended the Civil Service Commission meeting to discuss problems with the recent NOPD Lieutenant's examination.

For those unaware, when the video portion of the test was given, candidates were allowed 3 - 5 minutes to gather their thoughts and make any notes they thought would be helpful.  During the administration of the video portion of the test, candidates were allowed pencil and notepad to take notes on the video.  Due to an error by a particular Civil Service room monitor, two candidates were denied this privilege.  The two candidates viewed the entire video and supplied answers as directed.  Upon returning to the group of candidates who had completed the video, the two became aware that they were treated differently than the other 88 candidates and complained to Civil Service staff on-site.  A decision was made by Civil Service staff to allow the two candidates to retake the video portion of the examination.

Obviously, this created an advantage/disadvantage situation, and the three organizations filed complaints with Civil Service.  In previous meetings it was decided that Civil Service would move forward with grading all candidates' test, including both videos for the two candidates allowed to re-take the video portion.

F.O.P. LOSES FIGHT FOR TEMPORARY RESTRAINING ORDER

This past week, the Fraternal Order of Police in conjunction with the Police Association of New Orleans and the Black Organization of Police filed for a temporary restraining order to block the release of Public Integrity Bureau files requested by certain media outlets. The TRO was granted pending a hearing on the matter.

That hearing was held this morning before Judge Robin Giarrusso, who denied our request for a Preliminary Injunction and ordered the City and the Department to produce Public Integrity Bureau records on the officers involved in the Adolph Grimes incident, as well as the Public Integrity Bureau records of Superintendent Riley and Deputy Chiefs Bruce Adams, Kirk Bouyelas and Marlon Defillo. The Fraternal Order of Police, in consultation with the Police Association of New Orleans and the Black Organization of Police is considering our options for further legal action.

The Fraternal Order of Police strongly believes that certain information contained in Public Integrity Bureau files, including personal information on police officers such as social security numbers, home addresses, etc., and compelled statements made under threat of job forfeiture, which would otherwise be subject to 5th Amendment protections, should be held from public view.
